If you have ever been caught driving without insurance in Texas, you will probably be required to file SR22 insurance.

First, it’s NOT insurance.  Basically it’s proof of your financial responsibility or proof that you have a basic auto insurance policy.

You will need to have your auto insurance company file an SR22 for you. The SR-22 filing is usually required for about 3 years. But every state has it’s own rules and laws concerning SR22 insurance. Austin, or any city in Texas, is no different.

The SR22 filing shows proof of coverage to the TX DPS. Coverage is determined by the State. In Texas you must show proof of 30/60/25 liability limits.

  •  $30,000 per person/$60,000 per accident for bodily injury, and
  • $25,000 for property damage.  

If your coverage is cancelled early or there are lapse or gaps in your coverage, then your insurance company must inform the DPS immediately. This could result in the suspension of your drivers license with additional fines.

How will I know if I need SR-22?

An SR-22 is ordered by a court or your state. If it’s court-ordered, the judge will let you know at the hearing. If it’s state-ordered, you’ll typically get a letter from the Texas department of motor vehicles. (DMV)

Not everyone needs an SR-22.

It’s normally required if:

  • You’ve been caught driving without insurance or a valid license. 
  • DUI or DWI conviction
  • Too many at-fault accidents or violations
  • Repeat offenses in a short time frame (for example, three or more speeding tickets within six months)
  • Not paying court-ordered child support
  • Hardship license (issued for temporary driving needs, normally to and from work, because your license has been suspended or revoked)

How can I get an SR-22?

If you already have auto insurance, you may not need to purchase a new policy. You may be able to add the SR-22 to your existing policy, and your insurer will file the SR-22 document with the state requiring it.

If you don’t have auto insurance and need to buy a policy, you’ll want to let any prospective insurer know about the SR-22 up front. Many insurance companies don’t offer SR-22s and you shouldn’t waste time getting a quote if they’re unable to help.
